These policies apply to all Rainbow Flamingo Marketing packages, add-ons, and standalone services. By engaging our services, you agree to the terms outlined below. Questions? Just ask — we're always straight with you.

01. Payment Terms

All monthly retainer packages (Flamingo Lite, Flamingo Pro, Full Flamingo) are billed on a recurring monthly basis. Payment is due on or before the 1st of each service month. Work for that month begins upon receipt of payment — not before.

Flamingo Lite: $597/month · Flamingo Pro: $1,197/month · Full Flamingo: $2,197/month · Add-Ons / One-Time: 50% upfront, 50% on delivery

Invoices unpaid after 5 business days of the due date may result in a pause of active services. A $25 late fee applies after 10 days. Accounts 30+ days past due may be referred to collections and the client relationship terminated. Accepted payment methods: credit/debit card, ACH bank transfer, and PayPal. All prices in USD. A signed service agreement and completed onboarding form are required before work begins.

02. Cancellation Policy

We don't believe in locking people in. That said, we do ask for reasonable notice so we can wrap up deliverables properly and plan our workload fairly.

  • Monthly packages require a minimum of 30 days written notice prior to cancellation, submitted via email to your account manager.

  • The final month of service will be billed in full, even if the cancellation date falls mid-month. No prorated refunds are issued for partial months.

  • One-time add-ons that are already in progress cannot be cancelled once work has begun. If cancelled before kickoff, 100% of the deposit is refunded.

  • Immediate termination by Rainbow Flamingo Marketing may occur in cases of non-payment, breach of agreement, or conduct that is abusive or unlawful. In these cases, no refund of the current month's payment will be issued.

03. Refund Policy

Because our work is custom and time-based, we do not offer refunds on completed or in-progress monthly retainer services. We stand behind our work — if something isn't right, we make it right through revisions and direct communication, not refunds.

  • Monthly retainer — current month: Not eligible for refund.

  • One-time add-on — not yet started: Full deposit refunded.

  • One-time add-on — in progress: Not eligible for refund.

  • Duplicate charge / billing error: Full refund within 5 business days.

  • Services not rendered due to our error: Prorated credit or refund.

If we drop the ball — missed deadlines, incomplete deliverables, or quality that falls short of what was agreed — we'll make it right. That might mean a credit, a free add-on, or extended service time. We'll always work with you fairly.

04. Deliverables & Timelines

All deliverables are outlined in your package description and confirmed in your signed service agreement. We work from a shared content calendar, which is sent to clients by the 25th of the prior month for review and approval.

  • Content is delivered in batches based on an agreed schedule — typically weekly or bi-weekly depending on your package.

  • Clients have 48 hours to review and provide feedback on submitted content. After 48 hours with no response, content is considered approved and may be published.

  • Delays caused by client inaction do not entitle the client to additional deliverables or a discount for that month.

  • Deliverables are scoped per calendar month and do not roll over to the following month if unused.

  • Ad spend for Full Flamingo clients is billed separately and managed within a client-owned ad account. Rainbow Flamingo Marketing does not front ad spend on behalf of clients.

05. Revisions & Feedback

Every deliverable comes with a set number of included revision rounds. Revisions are defined as changes to approved work — not new requests or scope additions.

  • Flamingo Lite: 1 revision round per piece.

  • Flamingo Pro: 2 revision rounds per piece.

  • Full Flamingo: 3 revision rounds per piece.

  • Additional revisions beyond the included rounds are billed at $75/hour, invoiced at the end of the month.

  • A revision means refining existing content — not starting a deliverable over from scratch or requesting a complete change in creative direction.

  • Revision requests must be submitted in writing with clear, consolidated feedback.

06. Client Responsibilities

Great marketing is a partnership. We bring the strategy, creativity, and execution — but we need a few things from you to make it work.

  • Onboarding materials: Brand guidelines, logos, fonts, photography, and existing marketing assets must be provided within 5 business days of contract signing.

  • Access & permissions: Clients must grant admin access to required social accounts, website platforms, email tools, or ad accounts before work begins.

  • Timely feedback: All feedback must be returned within 48 hours of submission.

  • Accuracy of information: Clients are responsible for the accuracy of any business information, promotional claims, pricing, or offers included in their marketing materials.

  • Legal compliance: Clients are responsible for ensuring their business, products, and services comply with all applicable laws. Rainbow Flamingo Marketing is not liable for content approved by the client that is later found to be non-compliant.

  • Single point of contact: We work best with one designated point of contact per account to avoid conflicting feedback and communication delays.

07. Intellectual Property

Upon full payment for a given month or project, all final deliverables produced specifically for your brand become your property. Rainbow Flamingo Marketing retains no ownership rights over approved and paid-for work.

  • Work-in-progress content remains the property of Rainbow Flamingo Marketing until final payment is received in full.

  • Rainbow Flamingo Marketing reserves the right to use completed work in our portfolio, case studies, and marketing materials unless you request otherwise in writing at the time of signing.

  • Third-party assets used in your deliverables are sourced from properly licensed libraries. The client assumes responsibility for any custom third-party assets they provide that may be subject to licensing restrictions.

  • Our proprietary processes, templates, frameworks, and internal tools remain the exclusive property of Rainbow Flamingo Marketing and are not transferred to the client.

08. Confidentiality

We take your business information seriously. Anything you share with us — pricing, strategy, customer data, internal plans, or proprietary processes — is kept strictly confidential.

  • Rainbow Flamingo Marketing will not share, sell, or disclose any client information to third parties without explicit written permission, except where required by law.

  • Our team members and contractors are bound by the same confidentiality obligations.

  • Confidentiality obligations survive the termination of the client relationship indefinitely.

  • Clients agree not to solicit or hire Rainbow Flamingo Marketing employees or contractors directly for a period of 12 months following the conclusion of the service agreement.

09. Policy Changes

Rainbow Flamingo Marketing reserves the right to update or modify these policies at any time. We'll always give current clients at least 30 days advance written notice of any material changes before they take effect.

Pricing adjustments for existing clients will be communicated a minimum of 60 days in advance with the option to lock in current pricing for one additional month. New clients are subject to current rates at the time of signing.
